2. Description of Service

RFNI provides on-call notification and alerting services designed to help teams stay connected and responsive. Our Service includes:

• SMS and text message notifications
• Real-time alert delivery
• On-call schedule management
• Incident notification services

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts and Registration

To use certain features of our Service, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You are responsible for safeguarding your password and other account credentials. RFNI will not be liable for any loss or damage arising from your failure to protect your account information.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

5. SMS and Text Messaging

By opting in to receive SMS notifications, you consent to receive text messages from RFNI. Standard message and data rates may apply. You can opt out at any time by texting "STOP" to our short code. For assistance, text "HELP" or contact support@rfni.dev.

We are not responsible for delayed or undelivered messages. Message frequency varies based on your alert configuration and on-call schedule.

6. Service Availability and Reliability

While we strive to provide reliable service, we do not guarantee that the Service will be available at all times or that it will be uninterrupted, secure, or error-free. Factors beyond our control, including:

• Internet connectivity issues
• Telecommunications carrier problems
• Hardware or software failures
• Scheduled or emergency maintenance

may affect service availability. We will make reasonable efforts to minimize service disruptions but cannot guarantee continuous availability.

7. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by RFNI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purposes. This license does not include any right to:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RFNI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service
• Delayed, undelivered, or failed notifications

IN NO EVENT SHALL RFNI'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

RFNI DOES NOT WARRANT THAT:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• Any notifications will be delivered without delay or failure
• Any defects or errors will be corrected
• The Service is free from viruses or other harmful components

12. Indemnification

You agree to defend, indemnify, and hold harmless RFNI and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the Service

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RFNI operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RFNI regarding the Service and supersede all prior agreements and understandings, whether written or oral.
